Public Foundation “Sustenance and Development of the Rule-of-Law”, with the support of the Supreme Court of the Kyrgyz Republic, established a working group to improve the legislation regulating the mechanism of publishing judicial acts and information on court hearings on the website
sot.kg.
The working group proposed a number of legislative amendments and drafted detailed instructions for publication of judicial acts. This work is supported by the Collaborative Governance Program, funded by USAID and DFID.
Recommendations on the Draft Law “On Introduction of Amendments and Additions to the Law of the KR “On Access to Information which is Controlled by State Authorities and Local Governments of the Kyrgyz Republic” include suggestions on the delineation of the publication of judicial acts by categories of cases according to the following classification:
- List of court cases, the judicial acts which shall not be published;
- List of court cases, the judicial acts which can be published without de-identification (published in full);
- List of court cases, the judicial acts which shall be published only with a full de-identification (personal information of the trial participants of the court is deleted from the documents).
The draft instructions “On Procedure for Publication of Judicial Acts on the Internet Resource Sot.kg” provides an abbreviated list of criteria for de-identification and a simplified procedure for publishing information.
The above listed documents have been submitted to the Supreme Court of the KR and the Council of Judges of the KR for approval. Once approved, these documents will be proposed for public discussions and submitted to the relevant committee of the Jogorku Kenesh KR (Parliament). The drafted documents provide a simplified mechanism for the publication of judicial acts on Internet resource (online) to replace the current complicated procedure.

Collaborative Governance Program (CGP) promotes effective collaboration among civil society, the private sector, and the Government of the Kyrgyz Republic, and the private sector of the Kyrgyz Republic. The Program is funded by the United States Agency for International Development (USAID) and the United Kingdom Department for International Development (DFID), and is implemented by East-West Management Institute (EWMI).
